2. Scope of Managed Data and Purpose of Data Management During the completion of the contact form (Adobe Portfolio Contact Form) on the website, I request the following personal data:
Name: Required for contact and addressing.
E-mail address: Required for replying, sending price quotes, and communication.
Message content: To understand the details of the order or inquiry.
3. Legal Basis and Duration of Data Management The legal basis for data management is the voluntary consent of the Data Subject (i.e., the visitor) (GDPR Article 6(1)(a)). I manage the data until the contact is closed, or in the case of a possible order, until the fulfillment of contractual obligations (e.g., invoicing), or for the retention period required by law. Consent can be withdrawn at any time at the info@markhege.com e-mail address.
4. Data Processors The website's contact form operates through the system of Adobe Systems Software Ireland Limited (Adobe Portfolio). The data entered on the form reaches my provided e-mail address through Adobe's secure servers. Adobe's privacy policy can be viewed on the company's official website. Furthermore, I use the services of Google LLC (Gmail) for electronic mailing.
5. Rights of Data Subjects You have the right to request access to, rectification, erasure, or restriction of the processing of your personal data. In case of a complaint, you can turn to the National Authority for Data Protection and Freedom of Information (NAIH).
GENERAL TERMS AND CONDITIONS (T&C)
(Regarding photographic services)
1. General Provisions The scope of this T&C covers all services (wedding photography, event photography, portrait photography, theater photography) ordered by the Client from Márk Hegedűs, sole proprietor (hereinafter: Service Provider) through the https://markhege.com website, via e-mail, or during a personal consultation.
2. Order and Price Quote Contacting (via website form, e-mail, phone) does not constitute an official order. The Service Provider prepares a custom price quote based on the received information. The contract is established upon the Client's written (e-mail) acceptance of the price quote.
3. Service Fees and Payment Terms Service fees are always included in the issued custom price quote. The Service Provider is VAT-exempt (AAM), so the quoted net prices are equal to the gross prices. Payment – unless otherwise agreed – is made via bank transfer or in cash, based on an electronic invoice issued after the photography session, upon delivery of the photos.
4. Fulfillment of Service and Photo Delivery The Service Provider ensures a professional technical background (multiple camera bodies, backup equipment) during the photography. Handing over raw (RAW), unretouched photos is not possible for professional and quality assurance reasons. The Client exclusively receives JPEG format photos carefully selected and post-processed (light and color corrected, retouched if necessary) by the Service Provider. The photos are delivered digitally on a password-protected online cloud storage (or private online gallery) within the agreed deadline.
5. Copyrights and Usage According to the Hungarian Copyright Act in force (Act LXXVI of 1999), the copyright of the completed photographs belongs fully and irrevocably to the Service Provider (Márk Hegedűs).
Client's rights: The Client may freely use, reproduce, and share the photos for personal purposes. In the case of a corporate order, the photos can be used on the company's own communication and marketing platforms, but their resale to a third party is not permitted.
Reference: The Service Provider is entitled to display the completed photos in their own portfolio, website (markhege.com), and social media platforms as a reference, unless the Client explicitly prohibits this in writing upon concluding the contract (Non-Disclosure Agreement/NDA).
6. Liability and Force Majeure The Service Provider takes all necessary steps for maximum data security (multiple backups). In the event of force majeure (e.g., extreme weather, unexpected serious accident), the parties will jointly seek an alternative solution or date.
7. Cancellation Policy and Availability If the ordered event, function, or photography session fails and is canceled due to reasons beyond the Service Provider's (photographer's) control (e.g., the event is canceled, or the Client withdraws from the order), the Client is obliged to pay the cancellation penalty detailed below, considering that the Service Provider reserved the date exclusively for them:
General cancellation: If the cancellation occurs up to the 2nd day before the event (48 hours before the start), the Client is obliged to pay 50% of the previously accepted total service fee as a reservation fee.
Late cancellation (the day before, on the day, or on-site): If the cancellation occurs on the day before the event, on the day of the event, or if the Service Provider has already appeared at the site as agreed, the Client is obliged to pay 100% of the total, agreed service fee. In this case, the Service Provider is entitled to the full amount due to the preparations made, travel, and the resulting inability to sell the time slot to others.
(An exception is made if the parties mutually agree on a new, alternative date to make up for the photography session between the cancellation and the original date of the event.)
